No contract will exist between you and Appalachian Herb Growers Consortium (AHGC) until AHGC accepts your order by email confirming that your order has been received. We are under no obligation to accept your order, but will normally do so where the product is available.
Description, Specification and Price
The description and specification of products in the Web Site is only approximate; We will endeavor to ensure that any variation in the specification of the products does not adversely affect the performance of products supplied. To the best of our knowledge the product descriptions on the site are accurate and up to date; but we are continually working to improve our products and so specifications or processing changes may be made from time to time which have not been reflected on the site; We reserve the right to make changes which do not materially affect the quality or performance of those products. We include images of products on our site to help you with your selection, however all product images shown are for illustration purposes only. All measurements and weights are approximate.
Price and availability of products are subject to change and we reserve the right to withdraw any product from sale or to correct any error on the website without notice and without incurring any liability. The prices given in our product list, sales literature and web site are for information purposes only and do not represent an offer. No contract will come into existence until the customer’s order (however given) is accepted. Invoices will be raised for prices current at the time of order. The price of the products will be the price quoted in the Web Site at the time we accept your order except in the case of manifest error. Prices are quoted inclusive of Value Added Tax at the applicable rate.
We will notify you of our acceptance of your order by email shortly after we receive it and at that point a binding agreement between us will be in place based on these terms and conditions. If we do not accept your order for any reason or the price of the product has increased between the time of the order and our acceptance of it (or if a supplementary delivery charge applies), we will email you to advise you of the change. You will then need to confirm your amended order.
Payment of the price of an order must be received by AHGC and cleared before delivery. Payment can be made by any major credit or debit card, and will be debited and cleared from your account before the dispatch of your Goods. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery.
Appalachian Herb Growers Consortium products are used for a wide variety of purposes; It is the absolute responsibility of the customer and consumer to ensure that the products are appropriately used.
Ownership of Goods
Goods remain the property of Appalachian Herb Growers Consortium until paid for in full.
Shipping And Handling
Delivery is available within the United States only. In addition to the price of the goods, you will have to pay our delivery charges as quoted in the Web Site at the time we accept your order. Postage and Packaging charges are calculated by weight. We use USPS for deliveries.
FREE delivery is available on orders over $100.
Order online or by telephone and we make every effort to dispatch within 3 business days of order placement. Parcels should then reach you within 5 working days, but please allow up to 14 days.
Please note that deliveries are made to the address you supply to us. You can also arrange for your order to be delivered to alternative addresses.
As our stock depends upon annual harvests, we do not accept back orders.
For all orders that are not approved business resale or non-profit sales, a 5.3% sales tax will be added.
Credit Card Security
All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.
Appalachian Herb Growers Consortium warrants that Services and Goods will at the time of Delivery correspond to the description given by Appalachian Herb Growers Consortium. The products which are sold via this web site have been grown using Good Agricultural Practices and processed according to Agricultural Product regulation.
To the extent that we are lawfully able to do so, we expressly disclaim all warranties of any kind; including but not limited to; warranties of title; fitness for a particular purpose; merchantability and non-infringement of proprietary or third party rights. We make no warranty that the web site and our services or any information will meet your requirements, that your access to and use of the services will be error free and that any errors or inaccuracies will be corrected. Further if your use of the web site results in the need for servicing or replacing equipment or data this will not be at our risk and expense.
We expressly disclaim any claims, losses and/ or damages of any nature resulting from: (a) unauthorized access to or alterations of your transmissions or data; (b) statements or conduct of any third parties. (c) defect in the goods arising from incorrect storage by the customer. Dried herbs should be kept in air-tight opaque containers in a cool place out of direct sunlight. If cared for correctly, herbs will remain active for long periods.
You agree that; your use of the web site and our services is at your sole risk; The web site and services are provided on an as is and as available basis. No advice or information, whether oral or written, obtained by you through or from the web site or from our services will create any warranty not expressly stated in these terms and conditions. You agree to indemnify Appalachian Herb Growers Consortium and its Directors and hold us harmless from and against any claims; actions or demands, including any legal fees incurred in connection therewith, resulting from your misuse of our web site or your breach of these terms and conditions. We will notify you promptly of any such claim, action or demand and will assist you as may be reasonably necessary providing you meet our costs and expenses, including our legal fees. In no event will our liability arising out of or in respect of these terms and conditions exceed $1,000 US and that in no event will we be liable for any loss of profits, goodwill, loss of business, loss of data or any other indirect or consequential loss or damage whatsoever, except that this exclusion of liability does not apply to any damages in connection with death or personal injury caused by the negligence of Appalachian Herb Growers Consortium, its directors or employees.
We will not be liable to you for any breach of our agreement, for delay or failure to perform if the delay or failure is due to acts of God, civil commotion, riots, floods, drought, fire, legislation or other cause beyond our reasonable control. This does not affect your statutory rights. If we choose not to enforce a right under our agreement, that decision will not prevent us from enforcing other rights, or the same right on a later occasion.
As we are not responsible for the operation of the secure link we will not, unless we are negligent, be liable for any loss you may suffer if a third party obtains unauthorized access to any information you provide via such link.
If any of these terms and conditions are found to be invalid, then that provision shall not affect the validity of the remaining provisions which shall remain fully enforceable.

Cookies are used on this shopping site to keep track of the contents of your shopping cart once you have selected an item, to store delivery addresses if the address book is used and to store your details if you select the ‘Remember Me’ Option.
Provided you keep your receipt; and the goods are unopened and it is within 10 days of the receipt date; you may exchange these goods or get a credit/debit card/check refund; depending on the method of your payment. You may cancel your order by notifying us in writing at any time up to 10 days after your products have been delivered. The notification should state your order number and give the reason for cancellation. If you cancel your order after we have dispatched the products; then you must return the products with the original documentation sent with each parcel to us. The products should be returned in a reasonable condition and delivery costs of returning any product will be payable by you. We recommend the use of a Recorded Delivery Service. We will credit your credit card promptly or issue a refund.
You can no longer cancel your order once you have opened the product containers or used the products; However; your statutory rights concerning the quality of those products will be unaffected.
Returning Incorrect or Damaged Goods
In the unlikely event that your order is incorrectly shipped or found to be damaged or defective, we shall give a full refund or replacement. Please contact us within 10 days of receipt of your goods. Returns should then be sent back to us at Appalachian Herb Growers Returns, 144 Silver Maple Lane, Pilot, VA 24138, including a copy of the original invoice. We will reimburse the cost of postage and packaging. The statutory rights of the customer are not affected by these conditions.
